The Law in Action workshop No. 5:
"DOCTRINE OF CONSIDERATION IN THE US AND POLISH CONTRACT LAW”
held on
2nd December 2008 (Tuesday), 6.30 p.m,
at Brudzińskiego Lecture Hall, Kazimierzowski Palace
Our tutors - world-famous contract law experts, will be:
Prof. George DAWSON – University of Florida, and
Prof. Wojciech J. KOCOT – University of Warsaw.
The workshop is an innovative attempt to compare the US and Polish Contract Law. The particular problem to be dealt with concerns one of the most troublesome doctrines of contract law, i.e. the doctrine of consideration.
It may be observed, that existence of doctrine of consideration is regarded as the main feature distinguishing contract law in common law systems from contractual relations in civil law jurisdictions. Being in theory and practice, as controversial as unclear, the doctrine of consideration is criticized by civilian scholars. However, continental lawyers tend to forget that also civilian legal systems recognize some forms of this doctrine.
The question whether, and if so, to which extent Polish Civil Code of 1964 and Judicature acknowledge the doctrine of consideration, will be the main problem discussed and debated during the workshop.
Prof. Dawson will present us the general characteristic and role of the common law doctrine of consideration. Whereas Prof. Kocot will try to answer the question - whether there are some forms of consideration recognized by Polish Civil Code or Judicature. The last but not least, students participating in the workshop will try to jointly recognize the extent to which Polish law adopts the doctrine of consideration in its common law meaning.
This is going to be a truly scientific research you may be a part of!
